Terms of Use

1. Agreement

pHBytes (the website at phbytes.com and the pHBytes app) is operated by La Vie en Rose LLC ("we," "us"). By using pHBytes or creating an account, you agree to these Terms of Use and our Privacy Policy. If you don't agree, please don't use pHBytes.

2. Who can use pHBytes

You must be at least 18 years old to create an account or buy Premium. pHBytes is offered for personal, non-commercial use.

3. Not medical advice

pHBytes provides general information about foods and tools to record your own meals and symptoms. It does not diagnose, treat, cure or prevent any disease, and it is not a substitute for advice from a doctor or other qualified health professional. Food pH values are typical averages and can differ from the food you eat. Patterns shown by the trigger tracker are based only on what you enter and are not a diagnosis.

Always talk with your doctor about your symptoms and before changing your diet or medicines. If you think you may have a medical emergency, including chest pain, call 911 right away.

4. Your account

Give accurate information and keep your password private. You're responsible for activity on your account. Tell us right away at support@phbytes.com if you think someone else has used it.

5. Premium subscriptions and purchases

• Plans. Premium is offered as a monthly subscription, a yearly subscription, or a one-time lifetime purchase, at the prices shown when you buy.
• Automatic renewal. Monthly and yearly plans renew automatically at the end of each period and charge the payment method on file, until you cancel.
• Canceling. Cancel anytime from Account → Manage subscription and billing. Canceling stops future charges; you keep Premium until the end of the period you've paid for.
• Lifetime. Lifetime means access to Premium for as long as we operate pHBytes. If we ever shut pHBytes down, we'll give at least 60 days' notice.
• Price changes. We may change prices. If the price of your subscription changes, we'll email you at least 30 days before the new price applies, and you can cancel before then.
• Payments. Payments are processed by Stripe. Prices are in US dollars, and taxes may be added where required.
• Failed payments. If a renewal payment fails, Stripe will retry it. If it still can't be collected, Premium will end.

6. Refunds

Refunds are handled under our Refund Policy, which is part of these terms.

7. Acceptable use

Please don't:

• copy, resell, scrape or redistribute pHBytes content, food data or recipes;
• try to get around Premium access, security rules or payment;
• interfere with pHBytes or other people's use of it, or upload harmful code;
• use pHBytes for anything unlawful.

We may suspend or close accounts that break these rules.

8. Your information

What you log belongs to you. You give us permission to store and process it only to run pHBytes for you, as described in the Privacy Policy.

9. Our content

The pHBytes name, logo, design, food ratings, written content and recipes belong to La Vie en Rose LLC or its licensors and are protected by law. You may use them only through pHBytes for your personal use.

10. Other services

pHBytes relies on other companies, including Stripe for payments, Google Firebase for accounts and storage, and Open Food Facts for barcode product details. Their own terms may also apply when you use those features. We aren't responsible for information provided by third-party databases.

11. Changes to pHBytes

We're always improving pHBytes and may add, change or remove features. If we remove a major Premium feature, we'll let subscribers know.

12. Disclaimer

pHBytes is provided "as is" and "as available." To the fullest extent the law allows, we make no warranties, express or implied, including that pHBytes will be error-free, always available, or that any food information is complete or accurate for your situation.

13. Limitation of liability

To the fullest extent the law allows, La Vie en Rose LLC won't be liable for any indirect, incidental, special or consequential damages arising from your use of pHBytes. Our total liability for any claim is limited to the amount you paid us for pHBytes in the 12 months before the claim. Some places don't allow these limits, so they may not apply to you.

14. Changes to these terms

We may update these terms. If a change is significant, we'll tell you by email or in the app before it takes effect. Continuing to use pHBytes after that means you accept the updated terms.

15. Governing law

These terms are governed by the laws of the State of Nevada, United States, without regard to its conflict-of-law rules. Any dispute that can't be settled informally will be handled in the state or federal courts located in Clark County, Nevada, except where the law where you live gives you the right to bring a claim in your home courts.
